These Terms of Service are entered into by and between you (“Client”) and Cedar Cone Photography LLC, doing business as Cedar Cone Luxury Elopements (“Company,” “we,” “us,” or “our”).

By booking services, submitting payment, or participating in a session, you agree to the following terms:

I. LIABILITY & SAFETY

1. Assumption of Risk

You agree to hold harmless Nisha Sridhar and Cedar Cone Luxury Elopements from any dispute in the event you become injured during your session or while on the studio premises.

Cedar Cone Luxury Elopements will not be held liable for any injury incurred by you, your family, or guests, nor for any damage to personal property during the photo session or while on studio premises.

2. Conduct & Respect

The client takes full responsibility for ensuring the photographer is treated respectfully by them and the guests present at the wedding.

If harassment, verbal or physical abuse, offensive behavior, or defamation occurs by the bride, groom, family members, or guests, the photographer reserves the right to leave the event immediately. No refund will be provided in such case.

II. BOOKING, PAYMENTS & CANCELLATIONS

3. Retainer & Payment Schedule

A non-refundable retainer fee of 50% of the package is required at the time of booking.

The remaining balance must be paid in full 30 days before the wedding date.

4. Cancellations

Cancellations made up to 60 days before the wedding will be subject to 50% of the session fee.

All cancellations made within 60 days of the wedding will be charged in full.

5. Print Orders

Prints may be ordered directly through the gallery and are fulfilled by professional labs.

Due to the custom nature of the work:

• Payment must be made in full at the time of ordering.

• Orders are subject to a 50% cancellation fee if canceled after placement.

• Once submitted to the lab, orders are non-refundable.

Payments may be made via cash, Visa, MasterCard, or American Express.

III. IMAGE DELIVERY & CREATIVE PROCESS

6. Image Selection

While many images are captured during your session, only those selected by the photographer will be shown for previewing.

Images with closed eyes, duplicates, test shots, or technical flaws will not be shown and may be permanently removed from archives after final rendering.

7. Sneak Peeks & Delivery Timeline

A sneak peek will be posted on Instagram within 2 days of the wedding and may be reshared by you.

Final images will be delivered in an online gallery within 30 days of the wedding.

Rush delivery requests will incur an additional charge.

8. Loss or Corruption of Images

If the entire set of photos is corrupted or lost before delivery, Cedar Cone Luxury Elopements will refund the full cost, excluding travel and accommodation expenses.

If only portions are lost, reasonable compensation or a reshoot will be offered. Refund in this case shall not exceed 50% of total fees.

9. File Retention

Delivery of digital images releases Cedar Cone Luxury Elopements from any liability due to loss or damage of the images after delivery and releases the Company from any obligation to maintain copies of digital files.

10. Artistic Opinion

Cedar Cone Luxury Elopements is not liable for the client’s subjective opinion of the images.

IV. COPYRIGHT & IMAGE USE

11. Personal Use License

If digital images are included in your package, you are granted a personal-use license allowing unlimited prints up to 8x10 for personal use only. This permission applies worldwide.

12. Prohibited Uses

You may not:

• Use images for commercial or editorial purposes

• Enter images into competitions

• Resell images

• Use images for advertising

• Edit images

• Print larger than 8x10 without written permission

13. Social Media Use

We request that watermarked images be used for social media sharing and that proper credit be given to the photographer.

14. Copyright Protection

The Copyright Act protects photographers by granting exclusive reproduction rights.

It is illegal to copy, scan, download, or reproduce images without written permission. Violators are subject to civil and criminal penalties.

V. EVENT CONDITIONS & COVERAGE

15. Lead Photographer Status

You agree not to hire another professional photographer unless agreed in writing at least 30 days prior to the wedding.

If another photographer is present, Cedar Cone Luxury Elopements will remain the lead photographer and all others must cooperate.

16. Force Majeure

If severe weather or unforeseen conditions prevent the photographer from attending, Cedar Cone Luxury Elopements will secure a suitable associate photographer at no additional cost or reduction in offerings.

17. Breaks

The photographer is allowed:

• 10-minute breaks every 4 hours

• A 20-minute lunch break for 8+ hours of coverage

18. Meals

For services exceeding 4 hours, proper meals must be provided for the photographer and team.

If meals are not provided, the team may step out for 45 minutes and the client will compensate $40 per meal per person.

19. Parking & Permits

All parking fees and required permits are the responsibility of the client.

20. Implicit Agreement

If this contract is not signed before the session, it is considered implicitly agreed upon through participation and payment.

VI. SMS COMMUNICATION TERMS (A2P COMPLIANCE)

By providing your mobile number and opting in, you agree to receive SMS communications from Cedar Cone Luxury Elopements.

Messages may include:

• Consultation confirmations

• Appointment reminders

• Wedding timeline coordination

• Service-related updates

• Follow-ups regarding your inquiry

• Promotional messages (only if separately consented)

Message frequency varies based on your interaction.

Message and data rates may apply depending on your carrier plan.

Carrier Liability Disclaimer
